The Supreme Court has nullified a ruling by the Court of Appeal, which ordered parties in the case over the leadership crisis facing the African Democratic Congress (ADC) to abide by the status quo ante bellum, news.ng reports.
You may recall that a few weeks ago, a three-member panel of the Court of Appeal dismissed the appeal filed by David Mark, national leader of the ADC, challenging the jurisdiction of Justice Emeka Nwite of the Federal High Court to hear the suit filed by Nafiu Gombe on the party’s leadership.
Presiding over the matter, the Court of Appeal ruled that the appeal by David Mark, a former President of the Nigerian Senate, was improper and filed without the authorisation of the trial court.
The appellate court directed that the case be returned to the trial court for proper hearing and that both parties abide by the status quo ante bellum.
Consequently, the Independent National Electoral Commission (INEC) derecognised the Mark-led leadership of the party until the court resolves the matter.
Unsatisfied with the decision of the court, Mark approached the Supreme Court to challenge the ruling.
