A Kano State High Court sitting on Miller Road has acquitted a commercial tricycle driver, Imran Mustapha, of a murder charge.

Justice Adam Abdullahi discharged and acquitted Mustapha after ruling that the prosecution failed to prove the case against him beyond the required standard.

The Kano State Government had charged Mustapha under Section 221 of the Penal Code. He pleaded not guilty.

During the trial, the prosecution called six witnesses, while the defence presented Mustapha to testify in his own defence.

The case arose from an incident at a filling station involving Mustapha and the late Alhaji Muhammad Mustapha.

The prosecution alleged that Mustapha hit the deceased’s vehicle at the filling station. Muhammad reportedly followed the tricycle driver, leading to an argument.

According to the prosecution, Mustapha subsequently struck Muhammad with his vehicle, resulting in his death.

However, after reviewing the evidence and submissions by both parties, Justice Abdullahi held that the prosecution had not established the charge against the defendant to the required standard.

The prosecution counsel, Usman Abdullahi, said the government was dissatisfied with the judgment and would appeal the decision.
