The Federal High Court in Abuja has dismissed a suit seeking to compel the Nigeria Police Force to reopen the investigation into the de@th of singer Ilerioluwa Aloba, popularly known as Mohbad.
Justice James Omotosho dismissed the case on Thursday, September 24, 2026, ruling that the Registered Trustees of Break the Silence Foundation lacked the legal standing to institute the action.
The suit, marked FHC/ABJ/CS/363/2026, sought an order of mandamus directing the police to conduct a fresh investigation into the circumstances surrounding Mohbad’s de@th.
The foundation had argued that the earlier police investigation was inadequate because certain people, including some relatives of the late singer, were allegedly not properly investigated.
However, Justice Omotosho said the foundation failed to provide the original police investigation report to establish that the earlier probe was flawed.
The judge described the claims as speculative and without sufficient evidence.
“This suit is therefore without credible evidence and thus without merit.”
Justice Omotosho also criticised lawyers for discussing ongoing cases through media interviews and social media posts, warning that such conduct could amount to professional misconduct and affect public perception of court proceedings.
Mohbad d!ed in Lagos on September 12, 2023, at the age of 27. His de@th has remained the subject of public debate and multiple legal proceedings.
