On Friday, a judge declared a mistrial in the high-profile case of an American woman who killed her three children, but he put the judgment on hold to allow the defense to appeal.
Judge William Sullivan announced that he was freezing his mistrial ruling in Lindsay Clancy’s trial for one hour to allow her lawyer to submit an appeal to a higher court.
The jury is deadlocked 11-1, with the majority obviously leaning toward finding Clancy, 36, not guilty by reason of insanity.
The unexpected changes came after the panel issued a message to the court Friday morning noting that it was with a “heavy heart” that they were unable to reach a decision, which has cast a spotlight on maternal mental health.
Clancy does not dispute strangling Cora (5); Dawson (3); and Callan (8 months), but claims she was suffering from postpartum psychosis, absolving her of criminal guilt.

If they can’t agree, the judge declares a mistrial, and prosecutors must decide whether to retry the case with a different jury.
Clancy’s lawyer, Kevin Reddington, has repeatedly urged that the recalcitrant juror be replaced with one of numerous substitute jurors, but Sullivan has refused to comply.
Clancy’s televised five-week trial, which included more than 80 witnesses and days of harrowing testimony, prompted a debate in the United States about maternal mental health.
Clancy has pleaded not guilty due to insanity, claiming she heard a voice commanding her to kill her children.
Her lawyers claim she died as a result of postpartum psychosis, a disorder that strikes one to two women out of every 1,000 births.
Prosecutors have rejected that notion, claiming Clancy carefully planned her children’s killings and was aware of the repercussions.
Psychiatrists and others close to Clancy, as well as her estranged husband, testified about her unstable mental condition during the trial.

Dozens of women clad in pink arrived at the Plymouth courthouse to show their support for Clancy — and to make a broader statement about women’s health.
During closing arguments, Clancy’s lawyer, Reddington, stated that she had made repeated requests for assistance before the killings but had received “lousy medical care” from the doctors she contacted.
Following the killings at the family home in Duxbury, Massachusetts, in January 2023, Clancy leaped from a second-story window in an apparent suicide attempt, paralyzing her from the waist down.
If convicted of first-degree murder, the former nurse will face life in prison without the chance of release.
Jurors can potentially find Clancy guilty of second-degree murder, manslaughter, or not guilty due to lack of criminal culpability, which would sentence her to a psychiatric institute.
The trial has brought back memories of a similar case that captivated the nation 25 years ago: Andrea Yates, a Texas mother who killed her five children in 2001.
Yates was first convicted and sentenced to life in prison, but a retrial in 2006 declared her not guilty due to insanity, and she was confined to a psychiatric hospital.
